1. ALGEMEEN

1. Bij inschrijving verklaart u zich akkoord met de Algemene Voorwaarden.

2. Zodra de inschrijving is verwerkt, is een overeenkomst met de Vrije Academie tot stand gekomen.

3. Deze overeenkomst heeft betrekking op de op het aanmeldingsformulier of op de site vermelde college, studiedag, lezing of excursie .

4. De onderhavige Algemene Voorwaarden maken deel uit van die overeenkomst.

5. In alle gevallen waarin de Algemene Voorwaarden niet voorzien, beslist de directie.

6. Tijdens alle activiteiten uitgaande van de Vrije Academie, zowel direct als indirect, is de deelnemer aansprakelijk voor door hem of haar toegebrachte schade aan goederen, eigendommen en gebouwen van zowel de Vrije Academie als van derden, alsook aan personen; ook indien er geen sprake is van opzet. De deelnemer dient in het bezit te zijn van een WA-verzekering.

7. De Vrije Academie is niet aansprakelijk voor schade, verlies, diefstal of beschadiging van eigendommen, goederen en geld of schade aan personen, door welke oorzaak ook, tijdens de van haar, direct of indirect, uitgaande activiteiten.

8. Aan eventuele getuigschriften, uitgaande van de Vrije Academie, zijn geen wettelijke bevoegdheden en/of rechten verbonden.

 

2. INSCHRIJVEN

1. Inschrijven is alleen en uitsluitend mogelijk via onze internetsite, www.vrijeacademie.nl, of met het aanmeldingsformulier uit de brochure van de Vrije Academie, of met het aanmeldingsformulier uit Taferelen, of via actiebonnen in combinatie met derden.

2. Het is niet mogelijk om telefonisch in te schrijven.

3. Het is niet mogelijk een plek in een college, studiedag, lezing of excursie voorwaardelijk te reserveren.

4. Het is niet mogelijk gratis of tegen betaling één of meerdere lessen als proefles te volgen.

5. Een inschrijving geschiedt voor het volledige college, studiedag, lezing of excursie en is bindend.

6. De datum waarop de Vrije Academie het aanmeldingsformulier ontvangt, is bepalend voor plaatsing in het college dan wel de studiedag, lezing of excursie.

7. Alle inschrijvingen worden behandeld op volgorde van binnenkomst.

8. Voor alle colleges, studiedagen, lezingen en excursies geldt: vol is vol.

9. Als een college, studiedag, lezing of excursie is volgeboekt wordt u op een wachtlijst geplaatst.

10. Bij plaatsing op de wachtlijst hoeft u het inschrijfgeld nog niet te betalen.

11. Komt er voor het desbetreffende college, studiedag, lezing of excursie een plaats vrij, of wordt er een extra college, studiedag, lezing of excursie georganiseerd, dan nemen wij contact met u op.

12. Plaatsing op een wachtlijst voor een college betekent niet dat u automatisch bent ingeschreven voor hetzelfde college in het volgende seizoen. U dient zich in het nieuwe seizoen opnieuw voor het college aan te melden.

13. Als u zich heeft ingeschreven voor een college ontvangt u een collegekaart, welke geldig is voor de duur van het desbetreffende college.

14. De eerder genoemde collegekaart dient u te allen tijde bij u te hebben en op verzoek aan de docent te tonen; zonder collegekaart geen toegang.

15. Bij verlies of diefstal van de collegekaart ontvangt u na betaling van €15,- een vervangend exemplaar.

 

3. VERZUIM, TUSSENTIJDS BEËINDIGEN EN ANNULEREN

1. Het verzuim van lessen, studiedagen, lezingen, excursie of andere activiteiten geeft geen recht op het inhalen van de les, lezing of excursie, noch op gedeeltelijke of gehele terugbetaling van het betaalde inschrijfgeld.

2. Het tussentijds door de deelnemer beëindigen van een college leidt in beginsel niet tot restitutie van het collegegeld.

3. Het door de deelnemer beëindigen van een college geeft geen recht op het aanhouden van een tegoed of de mogelijkheid tot het volgen van het college op een later tijdstip of in een ander seizoen.

4. In uitzonderlijke gevallen bij zwaarwegende omstandigheden uitsluitend voorzien van schriftelijk bewijs, zoals een doktersverklaring of een overlijdensverklaring e.d., kan de deelnemer of de erven een schriftelijk verzoek tot annulering met restitutie van (een deel) van het inschrijfgeld indienen. Het is vervolgens aan de directie ter beoordeling of dit verzoek gehonoreerd wordt.

5. Inschrijvingen voor eenmalige activiteiten, zoals lezingen en excursies, kunnen na een boeking niet meer worden geannuleerd. Restitutie van inschrijfgeld is derhalve niet mogelijk. Wel kunt u uw plaats zelf aan een ander in uw eigen omgeving afstaan.

6. Inschrijvingen voor colleges kunnen worden geannuleerd tot 3 weken voor de aanvang van het desbetreffende college. Een college bestaat uit minimaal twee bijeenkomsten.

7. Bij annulering binnen 3 weken voor aanvang van het college, wordt geen restitutie van het inschrijfgeld verleend. Wel mag u uw plaats zelf aan een ander in uw eigen omgeving afstaan.

8. Bij inschrijving voor een college dat start binnen 3 weken voor aanvang van het desbetreffende college, is het dus niet meer mogelijk te annuleren met restitutie van het collegegeld. Wel mag u uw plaats zelf aan een ander afstaan.

9. Annuleren is uitsluitend schriftelijk mogelijk, de annulering dient te worden gericht aan het secretariaat van de Vrije Academie.

10. Bij annulering tot 3 weken voor aanvang van het college, wordt het reeds betaalde inschrijfgeld gerestitueerd onder aftrek van annuleringskosten en eventuele administratie- en portokosten.

11. Indien bij annulering tot 3 weken voor aanvang van het college het inschrijfgeld nog niet is voldaan, blijven de annuleringskosten als betalingsverplichting staan en moet u deze betalen.

12. De eerder genoemde annuleringskosten bedragen €20,-, per persoon en per activiteit. Bij activiteiten onder de €50,-, geldt een bedrag van €10,- .

 

4. BETALEN

1. Betaling bij de Vrije Academie is mogelijk via een eenmalige machtiging, via iDeal of na ontvangst van een factuur.

2. Bij betaling na ontvangst van een factuur, wordt €6,50 aan administratiekosten per activiteit en per persoon in rekening gebracht.

3. Bij betaling via internet met iDeal of eenmalige machtiging, worden geen administratiekosten in rekening gebracht.

4. Wanneer u niet via internet betaalt, maar wel gebruik wilt maken van een eenmalige machtiging, wordt €4,90 aan administratiekosten per activiteit en per persoon in rekening gebracht.

5. Bij activiteiten onder de €50,-, betaalt u geen administratiekosten, ongeacht de betaalwijze.

6. De deelnemer is verantwoordelijk voor het nakomen van de betalingsverplichting, ook wanneer het factuuradres anders luidt dan het huisadres.

7. In het geval van niet tijdige of onvolledige betaling van het inschrijfgeld, kan de Vrije Academie de deelnemer de toegang tot de desbetreffende activiteit ontzeggen.

8. Bij blijvende niet (of niet volledige) nakoming van de betalingsverplichting, wordt de eerder genoemde overeenkomst ontbonden met instandhouding van de (volledige) betalingsverplichting van de deelnemer.

9. Bij blijvende niet (of niet volledige) nakoming van de betalingsverplichting worden de aanmaningskosten, alsmede alle kosten voor incasso en rechtsgang, op de deelnemer verhaald.

 

5. ALGEMENE INFORMATIE

1. De colleges, lezingen en excursies vinden alleen doorgang bij voldoende deelnemers, zulks ter beoordeling van de Vrije Academie.

2. Alle op de site, in Taferelen, in de brochure, in acties of in bevestigingen en/of overzichten genoemde data zijn indicatief. Aan de genoemde data kunnen geen rechten worden ontleend.

3. De Vrije Academie behoudt zich het recht voor wijzigingen aan te brengen in de programmering (zoals data, locatie, docent etc.) zonder restitutie van gelden.

4. De Vrije Academie is gerechtigd om haar moverende redenen een gehele of gedeeltelijke activiteit af te gelasten. De Vrije Academie is niet aansprakelijk voor gevolgschade hiervan, in welke vorm dan ook. Alle reeds betaalde inschrijfgeld wordt dan gerestitueerd pro rato.

5. Tenzij uitdrukkelijk anders vermeld, zijn eventuele reis-, verblijfs- en toegangskosten voor rekening van de deelnemer.

6. Tenzij uitdrukkelijk anders vermeld, zijn alle activiteiten in musea exclusief de (wekelijkse) toegang tot het museum. Indien u in het bezit bent van een Museumkaart is de entree vaak (maar niet altijd) gratis. Een Museumkaart wordt derhalve aanbevolen.

7. Excursies die onderdeel zijn van een activiteit zijn alleen toegankelijk voor de betreffende deelnemers. Introducés zijn niet toegestaan en worden te allen tijde geweigerd.

8. Het is niet toegestaan lessen en/of excursies te volgen in een andere groep, bij een andere docent of op een andere locatie. Gemiste lessen en/of excursies kunnen niet worden ingehaald.

 

6. OVERIGE BEPALINGEN

1. De vroege inschrijfkorting van €10,- is alleen geldig binnen de op de site of in de brochure vermelde periode, en dan uitsluitend bij betaling via machtiging of iDeal.

2. Alle activiteiten onder de €125,- zijn uitgesloten van de eerder genoemde vroege inschrijfkorting.

3. Kortingen zijn niet tegelijk van toepassing. In geval van overlap, wordt automatisch het voor u voordeligste kortingstarief gehanteerd of, indien anders, vermeld bij de betreffende activiteit.

4. Bij verminderde validiteit dient u ons van te voren te bellen en te informeren naar de mogelijkheid tot het volgen van de betreffende activiteit. Bij verzuim hiervan bent u zelf verantwoordelijk voor de gevolgen en kunt u na aanvang van de activiteit geen rechten tot annuleren meer doen gelden.

DISCLAIMER: De Vrije Academie kan op geen enkele wijze aansprakelijkheid aanvaarden voor directe of indirecte schade die is ontstaan ten gevolge van onjuiste of onvolledige informatie op deze website.

 

General Terms and Conditions

 

1. GENERAL STIPULATIONS

1. You agree to these General Terms and Conditions when you register.

2. Once your registration has been processed, you are considered to have entered into an agreement with De Vrije Academie.

3. Your agreement with De Vrije Academie relates to the lecture, class, study day or study visit noted on the registration form or on the website.

4. These General Terms and Conditions form part of your agreement with De Vrije Academie.

5. Situations not provided for by these General Terms and Conditions will be decided by the management.

6. You will be held liable for any damage you cause to goods, property and/or buildings owned by De Vrije Academie or third parties, and for any injury you cause, during any activity organised by De Vrije Academie either directly or indirectly. This applies even if the damage or injury is inflicted unintentionally. As a participant you must have third-party liability insurance.

7. De Vrije Academie is not liable for loss, theft or damage of property, goods or money or for personal injury sustained during any activity organised by De Vrije Academie either directly or indirectly, regardless of the cause.

8. Certificates issued by De Vrije Academie do not confer any legal powers and/or rights.

 

2. REGISTRATION

1. It is only possible to register via our website, via  www.vrijeacademie.nl, or by completing the registration form in the De Vrije Academie brochure or Taferelen art magazine, or by filling in a special offer voucher issued in association with a third party.

2. It is not possible to register by telephone.

3. It is not possible to provisionally reserve a place for a lecture, class, study day or study visit.

4. It is not possible to attend one or more classes as a taster class, either on payment of a fee or free of charge.

5. Participants are required to register for the entire (series of) lecture(s), class(es), study day or study visit. Registration is binding.

6. The date on which De Vrije Academie receives the registration form determines the participant’s place at the lecture or class or on the study day or study visit.

7. Registration forms are processed in order of arrival.

8. There are a limited number of places for lectures, classes, study days and study visits. No exceptions will be made.

9. If a lecture, class, study day or study visit is fully booked, you will be put on a waiting list.

10. You do not have to pay the registration fee while you are on the waiting list.

11. If a place becomes available for the lecture, class, study day or study visit in question, or if an extra lecture, class, study day or study visit is organised, we will contact you.

12. The fact that you have been put on a waiting list for a lecture does not mean that you will automatically be registered for the same lecture during the following season. You will need to register for the lecture again when we start taking bookings for the new season.

13. Once you have registered for a lecture you will be sent a lecture pass which is valid for the duration of the (series of) lecture(s) in question.

14. You must carry the lecture pass with you at all times and must be able to present it to the tutor on request. Participants who are unable to present their lecture pass will not be admitted to the lecture.

15. If a lecture pass is lost or stolen it is possible to obtain a replacement for a fee of €15.00.

 

3. NON-ATTENDANCE, FAILURE TO COMPLETE AND CANCELLATION

1. The fact that you fail to attend a lecture, class, study day or study visit or any other activity does not give you the right to repeat the lecture, class or study visit, nor does it mean that you are entitled to a full or partial refund of the registration fee.

2. The fact that you fail to complete a series of lectures does not mean that you are entitled to a refund for the part of the series that you fail to attend.

3. The fact that you fail to complete a series of lectures does not mean that you are entitled to a credit note, or that you can attend the lecture at a later date or during another season.

4. In exceptional cases, if there are serious mitigating circumstances, which must be confirmed in writing by a document such as a doctor’s certificate or a death certificate, the participant, or the participant’s heirs, can write to De Vrije Academie and ask that their registration be cancelled in exchange for a refund of the (remainder) of the registration fee. Refunds are issued at the management’s discretion.

5. A registration for a one-off activity, such as a single lecture or a study visit, cannot be cancelled once the registration has been made and the registration fee for a one-off activity is non-refundable. However, it is possible for you to give your place to someone else.

6. A registration for a series of lectures can be cancelled up to three weeks prior to the start of the series. A series of lectures consists of at least two lectures.

7. If a registration for a series of lectures is cancelled less than three weeks prior to the start of the series, the registration fee is non-refundable. However, it is possible for you to give your place to someone else.

8. If you register for a series of lectures that starts within the next three weeks, the registration cannot be cancelled and the registration fee is non-refundable. However, it is possible for you to give your place to someone else.

9. A registration can only be cancelled in writing. Notice of cancellation must be addressed to the Secretariat of De Vrije Academie.

10. If a registration is cancelled up to three weeks prior to the start of the series, the registration fee, minus any cancellation fee, administration fee or postage charges that may apply, will be refunded.

11. If a registration is cancelled up to three weeks prior to the start of the series and the registration fee has not yet been paid, the participant is still obliged to pay the cancellation fee.

12. When cancelling a registration, the cancellation fee is €20.00 per person per activity. If the registration fee for the activity in question is less than €50.00, the cancellation fee is €10.00.

 

4. PAYMENT

1. Registration fees can be paid by single direct debit, via iDeal or on receipt of an invoice.

2. Payment on receipt of an invoice will include an administration fee of €6.50 per person per activity.

3. There is no administration fee for online payments made via iDeal or by single direct debit.

4. If you wish to pay by single direct debit but do not wish to pay online, you will be charged an administration fee of €4.90 per person per activity.

5. If the registration fee for the activity in question is less than €50.00, there is no administration fee, regardless of the method of payment.

6. The participant is responsible for the fulfilment of the payment obligation. This also applies if the billing address differs from the participant’s home address.

7. If the participant fails to pay the registration fee (in full and on time), De Vrije Academie is entitled to deny the participant admission to the activity in question.

8. In the event of continued failure to meet the payment obligation, the agreement between the participant and De Vrije Academie will be dissolved, with the participant still being obliged to meet the (full) payment obligation.

9. In the event of continued failure to meet the (full) payment obligation, the participant will be obliged to cover the cost of all demands for payment, and all debt collection and litigation costs.

 

5. GENERAL INFORMATION

1. Lectures, classes and study visits will only be held as scheduled if there are a sufficient number of participants. De Vrije Academie will determine what constitutes a sufficient number of participants.

2. All dates noted on the website, or in Taferelen art magazine, the De Vrije Academie brochure, special offers, confirmations and/or summaries are purely indicative. No rights can be derived from these dates.

3. De Vrije Academie reserves the right to make amendments to the programme (including the changing of dates, locations and tutors) without being obliged to issue a refund.

4. De Vrije Academie is entitled to cancel all or part of an activity for reasons of its own. Should this be the case, De Vrije Academie is not liable for consequential losses of any kind. A refund will be issued for the corresponding part of the registration fee if the registration fee has already been paid.

5. In the absence of an explicit indication to the contrary, any travel and accommodation expenses and admission charges must be covered by the participant.

6. In the absence of an explicit indication to the contrary, the fee for activities held in museums does not include the price of admission to the museum. If you have a Museumkaart pass, admission is often (but not always) free. The purchase of a Museumkaart pass is therefore recommended.

7. Study visits that form part of an activity are only open to the participants in question. Guests are not allowed to accompany participants and will be turned away.

8. It is not possible for participants to repeat missed lectures, classes and/or study visits with another group, another tutor or at another location. Missed lectures, classes and/or study visits cannot be repeated.

 

6. OTHER PROVISIONS

1. The early registration discount of €10.00 only applies to payments made via iDeal or by single direct debit during the period specified on the website or in the brochure.

2. The early registration discount does not apply if the registration fee for the activity in question is less than €125.00.

3. Discounts cannot be applied in conjunction. If you qualify for more than one discount, in the absence of an indication to the contrary, the discount that is most advantageous for you will automatically be applied.

4. If you have a limiting disability you are obliged to call us in advance in order to inform us of the extent to which you are able to follow the activity in question. Should you fail to do so, you yourself are responsible for the consequences and cannot exercise your right to cancel once the activity has started.
